Pierce Atwood's Bill Kayatta and Cliff Ruprecht won a hard-fought victory in the Sixth Circuit January 12, reversing the trial court's grant of class certification. The decision is unpublished and has a dissent:

The issue of what constitutes the "rigorous analysis" needed at the trial court level to determine whether class certification is appropriate is now being explained by the various Courts of Appeals. Bill and Cliff won another victory in March in the First Circuit applying that test:
